Employee Sues Orlando Health for $1.3 Million After Accidental Needle Prick

Yesenia Cosme, 26, has been a Medical Assistant at Orlando Health for 8 months. This past Monday, October 8, 2018, she suffered from an accidental needle prick while drawing blood from a high-risk patient. The employee claims that Orlando Health refused to handle the matter right away, instead asking her to wait 3 days prior to sending her to seek medical attention.

"It's not right", stated Cosme, while unscrewing the cap of her antiviral medication. "They refused to send me to get treatment and they blamed me for the incident."

BreakingNews spoke to the VicePresident of Operations at Orlando Health, Marsha Burns, who oversees the Human Resources Department. Burns stated that Cosme was negligent in administering the injection to the high-risk patient by not following company protocol. Burns mentioned to BreakingNews that the employee has been placed in an unpaid suspension leave until a new investigation into the incident has concluded.

Orlando Health is the third largest employee in Central Florida and a search into the local county court records indicates that several employees have filed lawsuits for similar incidents in the past 5 years. This year alone, there have been over 400 claims from various employees who allege the local health corporation has refused to provide treatment after potentially dangerous incidents that have taken place during work hours.

Meanwhile, Yesenia Cosme has retained legal counsel from Morgan & Morgan, a highly successful defense attorney in Central Florida. The law firm has accepted to represent her in the case and filed a lawsuit in the Orange County Courthouse this morning in the amount of $1.3 million, claiming physical and emotional distress for Cosme.

Attempts to reach the Risk Management department at Orlando Health have been unfruitful, with the company sending out the following statement:

“Orlando Health is committed to the health and well-being of all its patients and employees in Central Florida. Ensuring that our employees are well taken care of is our highest priority, and an investigation is currently taking place to identify any failures in following established safety protocols. At this time, we have no further comments until the investigation is completed.”

A review of the court documentation reveals that Orlando Health has requested to meet with the employee and her legal representative later this afternoon to discuss the possibility of a settlement and bypass a lengthy court process.
